Terms and Conditions for the RUN 'N' GUN Online Store Operated via the Shopify Platform
Effective from: April 28, 2025
1. General Provisions
1.1 These terms and conditions ("Terms") govern the rights and obligations between the operator of the RUN & GUN online store ("Seller") and individuals or legal entities entering into a purchase agreement with the Seller ("Buyer") via the online store at www.runngun.eu ("E-shop").

1.3 These Terms form an integral part of every purchase contract concluded via the E-shop. The Buyer must read and accept these Terms before confirming an order.
2. Custom-Made Production
2.1 Most products offered in the E-shop are custom-made according to the Buyer’s specifications, within the meaning of Section 1837(d) of the Czech Civil Code.
2.2 Production begins only after payment is received unless otherwise agreed.
2.3 The Seller reserves the right to refuse an order if:
• the necessary materials are unavailable,
• the content violates laws (e.g., engraving of hate symbols, discriminatory or extremist content, or copyright-protected materials without license),
• the order is technically unfeasible,
• there is suspicion of fraudulent activity.
3. Orders and Conclusion of Contract
3.1 A purchase contract is formed when the Buyer submits an order and the Seller confirms it.
3.2 Order modifications after confirmation are only possible upon mutual agreement and before production starts.
3.3 The Seller is not obliged to accept an order, especially for capacity, technical, or legal reasons.
4. Prices and Payment Terms
4.1 All prices on the E-shop are final; the Seller is not a VAT payer.
4.2 Final pricing may vary based on the Buyer’s specific requests and is always confirmed before the order is finalized.
4.3 Payment is accepted only in cashless form:
• Bank transfer
• Credit/debit card via secure payment gateways
4.4 Production and shipping begin only after full payment is received.
5. Shipping Terms
5.1 For custom-made products, the production time is usually 1–4 weeks.
5.2 In-stock items are typically shipped within 1–2 business days of receiving payment.
5.3 Shipping is handled by contracted carriers (e.g., Zásilkovna, PPL, DPD, Czech Post, DHL, etc.). The Seller reserves the right to change carriers for faster or safer delivery.
5.4 Shipping costs are shown during the checkout process.
5.5 Delivery is available within the Czech Republic and the EU.
6. Right of Withdrawal
6.1 The Buyer has no right to withdraw from the contract in the case of custom-made goods (§ 1837 of the Civil Code).
6.2 Withdrawal is only possible for in-stock, non-customized goods within 14 days of delivery.

7. Complaints and Liability for Defects
7.1 The Seller guarantees the goods will be free of defects at the time of delivery.
7.2 The Buyer must report defects without undue delay, no later than 14 days after discovery.
7.3 Complaints must be submitted via email (info@runngun.eu) with a description, photo evidence, and order number.
7.4 Complaints are processed within 30 days of receipt.
7.5 Legitimate complaints will be resolved by:
• Repair,
• Replacement,
• Partial refund,
• Full refund.
7.6 Warranty does not apply to:
• Normal wear and tear,
• Mechanical damage,
• Improper use, storage, or care,
• Damage caused by chemicals or moisture,
• Color differences in camouflage patterns.
8. Visual and Manufacturing Variations
8.1 Patterned or camouflage materials may differ slightly from item to item. These variations are not considered defects.
8.2 Product photos may not exactly match the delivered item, especially for custom-made or hand-crafted products.
9. Data Protection
9.1 Personal data is processed in accordance with GDPR and used solely for order fulfillment.
9.2 Details are available in the document "Privacy Policy".
10. Pre-Orders
10.1 Products marked "Pre-order" are produced or shipped only after the stated period.
10.2 Pre-orders are binding and non-refundable after payment.
10.3 Delivery time is typically 1–8 weeks from the end of the pre-order period.
10.4 Size exchanges are possible by agreement and only if the product is returned unused and in original condition.
11. Returns and Exchanges for In-Stock Items
11.1 The Buyer may return unused, unwashed, and undamaged goods in original packaging.
11.2 Return shipping costs are borne by the Buyer.
11.3 After inspection, an appropriate refund will be issued or reduced if signs of use are visible.
12. Textile Products
12.1 Custom textile goods are not subject to withdrawal rights (§ 1837).
12.2 Buyers are responsible for selecting the correct size using size charts. Size exchanges are only possible by agreement and based on availability.
13. Customer-Owned Product Modifications
13.1 The Seller offers repair and modification services for customer-supplied items.
13.2 The Buyer accepts full responsibility for any changes made and their impact on the product.
13.3 Only the work performed by the Seller can be subject to complaint—not the original product.
14. Custom Engraving and Patches
14.1 Buyers must provide high-quality graphics.
14.2 Minor variations in color, depth, and placement are acceptable.
14.3 The Buyer is solely responsible for copyright compliance of submitted materials.
15. Security and Authority-Labeled Products
15.1 Items labeled (e.g., POLICE, ARMY) are sold in good faith to professionals or collectors.
15.2 The Buyer is responsible for lawful use and wearing of such products.
16. Final Provisions
16.1 These Terms are effective as of April 28, 2025.
16.2 The Seller reserves the right to update the Terms; new versions become effective upon publication.
16.3 Legal relations are governed by the laws of the Czech Republic.
16.4 If any provision is invalid, the rest remain in force.
